Overview
This website is operated by Ample Hydration LLC ("Ample," "we," "us," or "our"). By visiting drinkample.com or buying from us, you agree to these Terms of Service, along with our Shipping Policy, Refund Policy, and Privacy Policy, all of which are part of these Terms.
Please read them before you use the site. If you do not agree, do not use the site.
Our store runs on Shopify, which provides the ecommerce platform we use to sell to you.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, to buy from us or create an account. If you are under that age you may use the site only with the involvement of a parent or guardian.
2. Accounts
You are responsible for keeping your account credentials secure and for everything that happens under your account. Tell us right away if you think someone else has access to it. We may suspend or close an account that is being used in a way that breaks these Terms.
3. Products, Pricing, and Availability
We work hard to show our products accurately, but colors and images on your screen may not match the product exactly.
Prices are in US dollars and can change without notice. Product availability can change without notice. We may limit quantities per person, per household, or per order, and we may limit or refuse orders that appear to be from dealers, resellers, or distributors.
We reserve the right to refuse or cancel any order. If we cancel an order after you have been charged, you get a full refund.
Occasionally a product or price may be listed incorrectly. If that happens, we may cancel the affected order even after it is placed, and we will refund you in full.
4. Subscriptions and Recurring Billing
This section applies if you sign up for Subscribe & Save.
What you are agreeing to. When you place a subscription order, you authorize us to charge your payment method automatically on a recurring basis at the frequency you select, at the subscription price shown at checkout, plus applicable tax and shipping, until you cancel. You will see the price, the frequency, and the discount before you complete your order.
Your discount. The Subscribe & Save discount applies to each subscription order for as long as your subscription is active. The discount varies by pack size and is shown at checkout. It cannot be combined with other offers unless we say so.
Reminders. We send an email before each renewal charge so you have time to skip, change, or cancel.
Price changes. If we change your subscription price, we will notify you by email at least 30 days in advance. The new price takes effect on your next renewal after that notice. You can cancel before it applies.
Making changes. You can skip a shipment, change your frequency, swap your pack size, update your payment or shipping details, pause, or cancel at any time from your account. No phone call, no email required, no cancellation fee.
Cancellation timing. Changes and cancellations must be made before your next order is processed to apply to that order. Cancelling stops future charges. It does not automatically refund an order that has already shipped. See our Refund Policy.
Failed payments. If a charge is declined, we will retry it and let you know. If we cannot collect after a reasonable number of attempts, your subscription may be paused or cancelled.
Our right to end a subscription. We may cancel or modify the subscription program, including discount levels and available pack sizes, with notice to active subscribers.
5. Promotions and Discount Codes
Discount codes are single use unless stated otherwise, cannot be combined unless stated otherwise, have no cash value, and can expire or be withdrawn. We may correct pricing or cancel an order where a code has been misused or obtained improperly.
6. Product Information, Ingredients, and Claims
Ample is a food and beverage product, not a supplement or medicine. Statements on this site have not been evaluated by the Food and Drug Administration, and our product is not intended to diagnose, treat, cure, or prevent any disease.
Ample contains one ingredient: organic maple water. Nutrition and ingredient information is provided as accurately as we can and is also printed on every can. Always read the can before drinking, especially if you have a food allergy or sensitivity. If there is ever a difference between the site and the can, the can is correct.
Nutrition values are typical values. Because maple water is a natural agricultural product, the mineral and sugar content can vary slightly between harvests.
Any comparison between Ample and other beverage categories on this site refers to those categories generally, based on commonly available products, and is not a claim about any specific competing product.
7. Reviews, Photos, and Other Submissions
If you post a review, photo, video, comment, or any other content on our site or tag us on social media, you give us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content in connection with our business, including in marketing, without payment or credit to you.
You confirm that the content is yours to share, that it does not violate anyone's rights, and that it is not unlawful, misleading, abusive, obscene, or defamatory. We are not obligated to publish, monitor, or keep any submission, and we may remove content at our discretion.
Reviews must reflect an honest experience with the product. We do not edit or delete reviews because they are negative.
8. Intellectual Property
The Ample and Ample Hydration names, logos, brand assets, photography, site design, and copy are our property or licensed to us, and are protected by trademark and copyright law. You may not copy, reproduce, sell, resell, scrape, or exploit any part of the site or its content without our written permission.
Third-party names and trademarks referenced on this site belong to their respective owners and are used only to describe or compare product categories. Their owners do not endorse or sponsor our products.
9. Prohibited Uses
You may not use this site to: break any law or regulation; infringe anyone's intellectual property; harass, abuse, defame, or discriminate against anyone; submit false or misleading information; upload viruses or malicious code; scrape, spider, or harvest data; collect or track other people's personal information; interfere with or circumvent the security features of the site; or resell our products without written authorization.
10. Third-Party Tools and Links
The site uses third-party services and may link to third-party websites, including retailer listings in our store locator. We do not control them and are not responsible for their content, accuracy, or practices. Third-party tools are provided "as is." Review the terms and privacy policies of any third-party service before you use it.
11. Disclaimer of Warranties
We do not guarantee that the site will be uninterrupted, secure, or error free, or that any results from using it will be accurate or reliable.
Except as expressly stated by us or required by law, the site and everything sold through it is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Ample Hydration LLC and its owners, officers, employees, and suppliers are not liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the site or any product bought through it, including lost profits, lost data, or replacement costs, even if we were advised such damages were possible.
To the fullest extent permitted by law, our total liability for any claim related to the site or a product will not exceed the amount you paid for the order giving rise to the claim.
Some states do not allow these limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
13. Indemnification
You agree to indemnify and hold harmless Ample Hydration LLC and its owners, officers, employees, and agents from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.
14. Dispute Resolution and Arbitration
Most problems can be sorted out quickly. Before starting any formal proceeding, please contact us at hello@drinkample.com so we have a chance to resolve it directly.
If we cannot, you and Ample Hydration LLC agree that any dispute arising out of or relating to these Terms or your purchase will be resolved by binding individual arbitration, administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring a qualifying claim in small claims court.
You and Ample Hydration LLC each waive the right to a jury trial and the right to participate in a class action or class arbitration.
Arbitration will take place in Bergen County, New Jersey, or by phone or video where the provider allows. This section survives termination of these Terms.
15. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. To the extent any dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Bergen County, New Jersey, and you consent to that jurisdiction.
16. Changes to These Terms
We may update these Terms at any time by posting the revised version here with a new "last updated" date. Continuing to use the site after we post changes means you accept them. Material changes to subscription terms will be sent to active subscribers by email.
17. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the rest stays in effect. These Terms, together with the policies referenced in them, are the entire agreement between you and Ample Hydration LLC regarding the site and supersede any prior version.
